Owners Of House With Construction Problems Trying To Deed It To Bank

The owners of a new house that was never occupied because of construction problems want to cut their losses and deed it to the bank.  

That is how dire the situation is for Jonathan and Anne Powell over the manufactured house they own  east of Okawville.  They had it placed on a lot they own at 11412 State Route 177, in December 2018. 

Although deeding the house to the bank would mean a complete loss of what they have already invested, it would free the Powells from future obligations. They want to deed it to the bank to avoid foreclosure and damaging their credit rating.

The Powells attempted to get $250,000 in restitution from Scott Banzai Homes/Kevin Wilson, from whom they bought the house, through a civil lawsuit. That effort failed because attorneys advised against a civil suit. “If we had had a lawyer that would have taken it to a civil suit we might have had a different outcome,” said Anne Powell.
